HDC LODGES APPEAL AGAINST SUPREME COURT RULING

The fight over the future of the Newcastle rail line stepped up a notch today.

Hunter Development Corporation lodged an APPEAL against a recent Supreme Court finding that the state government needs Parliament’s approval to cut the Newcastle rail line.

The government body filed with the Court of Appeal in Sydney at 10 o’clock this morning.

Under the Transport Administration Act, a ”rail infrastructure owner” needs parliament’s approval to close a line, but the government is aiming to get around the requirement.

Newcastle MP Tim Crakanthorp today called on the Minister for Transport to resign for not abiding by the law and misleading the community regarding future development along the rail corridor.

Hunter Development Corporation (HDC) who are an alliance of property speculators and the NSW Government are to appeal to the Supreme Court that the Transport Administration Act does not apply to them. This Act requires a rail owner to obtain an Act of Parliament before they can buy, sell or remove any rail infrastructure. In other words they wish to break the law any time it is convenient to them. Nothing impedes their ability to spend hundreds of thousands of dollars of our taxes employing the best legal minds to bypass the law. After all the ICAC findings, if this government had any conscience the Premier, the Transport and Planning Ministers would have resigned long ago.

  2. Easy, since you do not have abide by the rules. Just refuse to pay any state taxes.

  3. What creditable government connives with property developers to circumvent the law to deprive a thriving community of public assets? This government continues to behave in a questionable fashion while paying lip service to concepts like transparency. It appears devoid of any standards of decency in this matter.
