NO CHARGES FOR DEADLY DRAYTON’S BLAST

An inquest has found a deadly explosion at Drayton’s Hunter Valley vineyard was caused by ethanol vapours igniting during welding operations.
No charges were recommended – instead, the deputy coroner urged Workcover to consider a one-off campaign publicising the risks associated with the dangerous substance.

  1. Appears a council may have been ad-hock with fire saftey inspections/certificates/audits.I bought a very successful cafe, lease was inacted in 2007,this was totally destroyed by fire inJan,2010 along with 2 other shops,I have been informed by council, that no fire saftey certificates were subitted from the landlord or managing agent, for at least 3 years. This is illegal. The coroners report stated cause unknown, although assessors have said this began in a wall cavity, between my cafe and ajoining shop.Cafes ,kitchens are high risk,my shop was a tinter box ,no fire retardation just grade 3 asbestos. What were council thinking, when I asked why this was never addressed the general managers responce was they focus on food hygiene, while also stating in the same letter, that it was a old building, and it would not pass DA approval as a food out-let ,and the reason council allowed it was because it traded for 20yrs.I paid my inspection fees twice a year, and they were very quick to point out, all the things wrong that I needed ,to do as the leasee in regards to equiptment, stainless steel etc,yet in regards to the responsibility of the landlord, they lacked their duty of care for me,which now has sent me into financial ruin, and on the verge of losing my home as I used my equity,to purchase the cafe and secure my future.NBN actually covered the story on the fire,it was on 5/1/2010,my cafe was .called The Bayleaf,in Magnus St, Nelson Bay.I live in hope that one day someone will help me,although every solicitor I speak to don’t want to go near it,now one wants to take on Port Stephens Council, they have plenty of $$$$$ which appears to never run out.As I said before I live in hope ,because whats happened to me is wrong and anyone could be in this situation.I just remind myself of the little aboriginal man that toppled a land council,if he can do it …well so can I. Don’t suppose you could help? Thanks for listening,Lindy Anderson
