COURT OF APPEAL RULES IN FAVOUR OF BAIRD GOVERNMENT

The Hunter Business Chamber has welcomed a decision from the New South Wales Court of Appeal, which found the state government did not need an act of parliament to close the rail line.
The court found the closure of the section of track between Wickham and Newcastle Station did not constitute a closure of the line, under section 99A of the Transport Administration Act.
Business Chamber CEO, Kristen Keegan, says the decision sends a clear message.
“The decision as handed down today is final confirmation that the NSW Government is on the right path in regard to the renewal of our city centre. It is important now that we all move on to provide the best transport solution for our city and broader region,” she said.
The ruling also means Save Our Rail will have to cover the government’s legal costs.
