Refusal of Treatment ( Water Fluoridation)
Generally, under British based law, and certainly in Australia, the right to refuse medical treatment under most circumstances, and for people deemed competent ( including minors ), is clear and unambiguous.
Mandatory provisions in State Health Laws, though differing in detail, all reflect this legal position.
The High Court of Australia has stated that a legally competent person has a right “to choose what occurs with respect to his or her own person.”
The right to refuse treatment exists, notwithstanding that the reasons for making the choice are rational, irrational, unknown or even non-existent.
“Medical Treatment” in South Australian Health Legislation is defined as “ treatment or procedures administered or carried out by a medical practitioner in the course of medical or surgical practice or by a dentist in the course of dental practice and includes the prescription or supply of drugs.” Similar provisions apply under the various State Acts.
Now, to apply this to fluoridation of our water supply, the position appears to be:
1 .Fluoridation must fall under the definition of “medical treatment”, for if it did not, then all of the reasons for doing it are invalidated.
2. Given that it is medical treatment, it carries with it an absolute legal right of refusal, under all State Health Acts, under pain of criminal and/or civil legal action against any “Medical Personnel “, whose actions result in a violation of the persons right to refuse.
3. So, if our water supply was fluoridated, and a patient in Ballina Hospital, or any other medical facility, refused to ingest water as supplied by the local authority to that facility, then under health regulations, the medical staff would have no option, but to supply unfluoridated water to the patient, or risk legal sanctions.
4. So are we left with the proposition that Councillors, not being classified as “ Medical Personnel “, can ignore this generally inviolate legal principle, when making the decision to medicate those who, for whatever reason, wish to refuse that medication?
That they can do this without consequence because, and only because, they are not classified as” Medical Personnel ” under Health Laws?
I don’t think so ! Probably only so long as their right to make the decision, and / or their liability for so doing, is not tested at law.
Councillors – Walk softly – But put down the big stick
This is a !@##$% outrage! Who do these people think they are? Force medicating the puplic with a very toxic substance.
Are we a concentration camp or a free nation?
Well the people wont be able to rise up agaisnt this shortly as flouride is known to make humans docile. Thats why it was first itroduced to the water of the concentration camps of ww2.
It is also illegal to dump in the sea by international law because it is so toxic.
I Wonder how much money these “trusted” councilors are making from this by taking the waste product of the fertilizer making process and putting it in our water supply?
